1. Acceptance of Terms
Welcome to www.takesmartsteps.com, owned and operated by Take Smart Steps LLC ("Company," "we," "us," or "our"). By accessing or using our website, purchasing or accessing our educational materials and digital guides, or booking and enrolling in our educational services, including group seminars, workshops, and B2C 1-on-1 private coaching sessions across Pennsylvania, Florida, and other operating territories, you ("Client," "User," "you," or "your") agree to comply with and be bound by these Terms of Service ("Terms"). If you are accepting these terms on behalf of a senior retirement community, senior living facility, social organizations for older adults, senior center, adult daycare center, or any other corporate entity (each a "Facility"), you represent and warrant that you have the full legal corporate authority to bind that entity to these Terms. Continued use of the website or our services following any updates or revisions constitutes full acceptance of those changes.
2. Scope of Services & Daily Utility
Take Smart Steps LLC provides educational services, technology literacy training, AI awareness, and 1-on-1 private coaching designed to help older adults understand and use Artificial Intelligence (AI) for everyday life. Our core mission is empowerment and practical daily utility, including but not limited to teaching seniors how to use AI for:
- Daily Productivity: Writing letters, emails, and digital correspondence.
- Schedule & Reminders: Organizing personal schedules, calendars, and reminders.
- Living & Health Habits: Planning meals and tracking dietary preferences.
- Interests & Exploration: Researching personal interests, managing hobbies, and exploring travel destinations.
As a secondary, defensive element of our curriculum, we provide educational modules on digital safety and AI scam awareness to help older adults recognize fraud, tricks, and deceptive tactics that increasingly leverage AI technologies to target seniors.
3. Educational Disclaimers & Third-Party AI Platforms
- No Professional Advice: All content, seminars, training modules, digital guides, downloadable workbooks, and 1-on-1 coaching sessions are provided strictly for educational and informational purposes. Our training and materials do not constitute legal, financial, cybersecurity, medical, or certified IT technical advice.
- Third-Party AI Products & Hallucinations: Our services teach students how to interact with external, third-party generative AI platforms (such as ChatGPT, Google Gemini, Microsoft Copilot). Take Smart Steps LLC does not own, control, or guarantee the performance of these third-party platforms. AI systems can produce inaccurate, incomplete, misleading, or outdated information ("hallucinations"). Users are solely responsible for independently verifying all critical facts generated by an external AI tool before acting upon them.
- No Guarantee of Scam Immunity: While our scam awareness training provides defensive strategies and actionable safety practices, cyber fraud tactics evolve rapidly. Take Smart Steps LLC explicitly does not warrant or guarantee that attendance in our programs or use of our materials will completely eliminate the risk of cyber fraud, financial scams, identity theft, or electronic manipulation.
- Personal Account Management: Participants and clients retain full responsibility for managing their individual digital accounts, passwords, device settings, and personal financial security decisions.
4. Limitation of Liability & State Fair Trade Disclosures
To the maximum extent permitted by applicable law, Take Smart Steps LLC, its owners, members, employees, and independent contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages resulting from:
- AI Tools & Content: Reliance on, or actions taken based upon, content or advice generated by third-party AI software or taught during instructional sessions.
- Security & Scams: A client falling victim to a digital scam, financial loss, psychological distress, misinterpretation of educational frameworks, or misuse of third-party software platforms following a seminar or coaching session.
The total aggregate liability of Take Smart Steps LLC arising out of or related to your use of the website, digital materials, or services shall never exceed the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to liability.
Nothing in these Terms is intended to exclude, restrict, or modify any non-waivable statutory rights granted to consumers under the Pennsylvania Unfair Trade Practices and Consumer Protection Law (PUTPCPL) or the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. § 501.201 et seq.).
5. Intellectual Property & Digital Content Access

- License & Usage: Purchased digital materials and guides are licensed for individual or authorized community use as specified at the time of purchase. You are granted a limited, non-exclusive, non-transferable, revocable license to view, download, and print purchased content for personal enrichment (B2C) or internal community educational use (B2B). Purchased digital materials will be accessible in your account for viewing, downloading, and printing.
- Restrictions: Redistribution, modification, public display, reselling, or commercial exploitation of our proprietary materials or curriculum without explicit written permission from Take Smart Steps LLC is strictly prohibited.
6. Onsite and Facility Bookings (B2B Engagements)
For seminars and workshops hosted onsite or virtually at senior retirement communities, senior centers, adult daycare centers, social organizations for older adults, or host facilities in Pennsylvania, Florida, or other expansion markets, the following terms apply:
- Premises Liability & Accessibility: The host Facility retains exclusive control over, and liability for, the physical environment. The Facility is solely responsible for ensuring the premises are safe, accessible under the Americans with Disabilities Act (ADA) and applicable state accessibility statutes, and that proper operational, safety, and medical oversight is maintained for all participating residents or staff during the seminar.
- Operational Agreements & AV Provision: Specific terms regarding scheduling, venue setup (such as room and AV provision), presentation scope, cancellation, and fee schedules are governed by the mutual service agreement or proposal executed between Take Smart Steps LLC and the host community.
- Cancellation Policies: B2B bookings must be cancelled or rescheduled at least fourteen (14) business days prior to the scheduled seminar date. Cancellations made outside this window may be subject to a cancellation fee as detailed in your specific booking agreement.
- Commercial Billing: Facilities agree to pay invoices within thirty (30) days of receipt (Net 30). Late payments are subject to statutory interest penalties under applicable state commerce codes or a 1.5% monthly finance charge. Invoices may be paid by check, or by credit card, debit card, or ACH bank transfer through a secure Stripe payment link.
7. Private Coaching, Workshops & Proxies (B2C Rules)
- Zero Technical Intervention: Our coaches provide conceptual instruction and guided prompting workflow practice. Coaches are strictly educational guides and are prohibited from logging into a client's live financial accounts, handling bank instruments, managing account passwords, modifying hardware security settings, or acting as an active cybersecurity response unit.
- Signatory Capacity & Power of Attorney (POA): If an older adult student lacks legal capacity to enter into binding digital contracts due to cognitive frameworks, a legally designated guardian or agent holding a valid Power of Attorney (POA), executed in compliance with Pennsylvania state law (20 Pa.C.S. § 5601 et seq.) or Florida state law (Fla. Stat. § 709.2101 et seq.), must review and execute these Terms of Service on the student's behalf prior to the first session.
- Workshop Sign-Ups: Contact details provided by residents registering, or family members registering on behalf of a resident, for optional small-group workshops or individual sessions are managed in accordance with our Privacy Policy.
- Cancellation Matrix: Private coaching sessions cancelled less than 48 hours before the scheduled session time remain non-refundable due to dedicated staffing matrices.
